Appeal court overturns seizure

Yesterday the Court of Appeal in Kentucky stopped the state from seizing 141 domain names. After it decided they were not, under Kentucky Law, considered as ‘gambling devices’.
The names belonged to online gaming companies.

The order was issued by Franklin Circuit Court back in September after Steve Beshear, the Kentucky Governor filed a lawsuit against the 141 domain, stating there was a threat to the citizens of the state, “by the ease, availability and anonymity of unlicensed, unregulated, illegal internet gambling.”

However the judges ruled in favour of the domains with Judge Michelle Keller expressing her majority opinion that “ It stretches credulity to conclude that a series of numbers, or internet address, can be said to constitute a machine or offer other device, designed and manufactured primarily for use in connection with gambling”.

PokerStars, Full Tilt, Absolute Poker, and Bodog were some of the owners of the 141 domains threatened with closure. Microgaming also made the announcement while the order was pending appeal that all gambling casinos powered by their software would no longer accept US-based players.

Joe Brennan Jr, the chair man at Interactive Media Entertainment and Gaming Association (iMEGA), spoke after the ruling was announced saying, “we are happy with the courts ruling today, The judges clearly agreed with our interpretation of the law, and thankfully, this reverses what would have been a terrible precedent for our country and the internet.”

During the festive period Silver Oak saw two jackpot wins of over $50,000.

Two lucky women, Irma and Catherine on the 23rd and 27th of December managed to walk away with the grand prizes having only stake $1.

Both of them won their winnings on the Real-Video slots games Aladdin’s Wishes and Enchanted Garden. They were also quoted as saying very similar things, the armament of winning, and the excitement of the spending to come.

Irma hand planned to move house with her family (husband and three children) and said the winnings would go towards them being able to buy a nice place. Catherine however had not speculated as to what the winnings would be spent on.

A customer service manager at Silver Oak Casino, Mr Michael Daniels said “With the economy being as tough as it is, all we hear nowadays are doom-and-gloom stories. It’s always nice when we can share in the joy of a big jackpot with a customer. After all, all it takes is one click of the mouse to completely change someone’s life for the better. Every week we get to experience situations like that of Irma and Catherine, and every time it puts a smile on my face.”

Irma attributed her win to her husband’s decision stating it was he who chose to sign up at that site.
